-Here in Nevada, the penalties for sale of drugs
go up if you have prior convictions.
So for a first offense of sale of narcotics,
the penalty would be one to six years.
For a second offense, the penalty
would be two to 10 years.
And a third offense would carry a penalty of three to 15 years,
punishable as a category B felony.
-Many people are confused by the distinction
between sales and trafficking.
Unlike sales, trafficking carries much more serious
penalties and is defined under Nevada statute by the amount.
So for example, if someone has four grams or more
of a Schedule I controlled substance
such as methamphetamine, that would be trafficking,
or 28 grams or more of a Schedule II
controlled substance such as ***,
that would be tracking and not sales.
