Mistaken identification is the number one source
of wrongful conviction in robbery cases.
Often when a robbery occurs, if for example a deadly weapon was
used, the victims attention may be focused on that weapon.
And they may not get a good look at the assailant.
But the police sometimes will catch someone
and they'll say we found this person with your property.
And they'll do what's called a field show up,
where they'll transport that person so that the victim can
view them.
And it's quite common in that scenario
that the person's going to say yes, that's
the person that robbed me.
More often than not, the robber doesn't want to be seen.
So the crime is committed at night, there's darkness,
there's a hat, there's a cap.
But low and behold, the victim will
say I'm sure, that's the person that did it.
So we see a lot of cases where people are wrongfully
accused and/or convicted of robbery based
on a mistaken identification.
Another example where somebody might be wrongfully accused
of a robbery would be in a case involving
what's now commonly known as apple picking.
And of course, everyone knows Apple products
are very valuable.
And they can easily be resold or pawned
often for great sums of money.
Someone would walk up to someone that they
see with an Apple product and say, can I look at that?
And then they hold the item, they look at it,
and then they run off with the item.
In this case, the accuser may say, this person threatened me,
or this person use forced to take this from me.
Maybe because they don't want to face
the embarrassment of admitting that they were
so foolish to hand their valuable product to a party
that they didn't know.
Often in these types of cases, there may be more of the story
that we come to learn.
And this might be a case where what looks like a robbery was
really simply a larceny or theft.
