There are many ways to challenge a blood draw
during a DUI investigation in Nevada.
You can do an independent blood split
and have the blood retested to assure that you're
getting an accurate reading of what
your blood alcohol actually was.
First, under Nevada law, the blood
must've been taken within two hours of the time of driving.
Second, you have the right to challenge the chain of custody.
Was this your blood?
And can the state prove that the blood that they got a test
result from was actually the blood that was drawn from you?
Third, was the phlebotomist who took
the blood licensed to collect blood?
And was the chemist who tested the blood licensed
to test your blood?
