-It really depends on the application.
If the application asks if you have any convictions, you
could certainly say at that point, after you've had the
relief of expungement, that you don't.
But oftentimes, and we're seeing a lot of this lately,
where the application is saying, do you have any
convictions, including those that were expunged pursuant to
1203.4 of the Penal Code?
So it really comes down to what's on
the application form.
I tell clients, always be prepared to explain that they
had a prior arrest and conviction, that they have
since been given the relief by the court, and the matter has
been expunged.
