D PEW: That depends; on the one hand if you file for Bankruptcy before the eviction process
begins, then the Bankruptcy Automatic Stay will stop your landlord from terminating the
lease. Like any other situated creditor the landlord
must seek permission to initiate eviction proceedings, from the Bankruptcy Judge, by
filing a motion to lift the Automatic Stay. On the other hand, if the eviction was filed
before the Bankruptcy and the landlord already has a judgment to regain possession of the
rental unit, then the Automatic Stay will not prevent eviction from the premises.
