Is your pre-nup useless? Hi. I’m Eric Engel, Seattle divorce lawyer with the Engel Law
Group here in Seattle, Washington. We’ve seen a fair number of pre-nuptial agreements
that are essentially unenforceable. Now what that means is that the party has signed a
pre-nuptial agreement, but if the other party or if these parties want to get this agreement
enforced in court, they’re going to run into a lot of trouble. In one case we had
a person who wanted us to sign off on a pre-nuptial agreement that was drafted by a Nevada attorney,
who happened to be a friend of the person who’s asking us to review it. We wouldn’t
sign off on the document because it didn’t comply with Washington state law. But this
person wanted us to sign off on the document because essentially he didn’t want to pay
to actually have anyone draft a new one for him. Unfortunately for him, it turned out
that the pre-nuptial that he was trying to get signed off on was totally unenforceable.
And then when it came time for him to get a divorce, he ended not being able to have
the pre-nuptial agreement enforced. What this means is that he then became subject to standard
community property laws in Washington state, which means he was severely at risk. Don’t
put yourself in this situation. If you find yourself looking at a pre-nuptial agreement
drafted by LegalZoom or some attorney who happens to be a friend from another state,
you need to tread carefully. These are the sort of problems we deal with every day. If
