Your spouse or a loved one was struck and killed by a car while they were walking at
night. Do you still have a claim? Hi. I'm Ohio pedestrian attorney Will Eadie. Does
the fact that the person who died was walking at night mean that they don't have a claim?
It depends. If the driver of the car could and should have seen the person who died while
they were walking, then you may have a claim. And it will depend on exactly what the driver
of that car could and should have seen. And that's not something you can guess about,
it's not something you should take the insurance company's word. They'll always say they didn't
see the person walking across the street. But if they could and they should have seen
them, you may have a claim. We use accident reconstructionists, we'll visit the scene
and determine exactly what the lighting conditions were and exactly when the person should have
been seen by the driver of the car. Now why does this matter? Because your spouse or relative
was struck and killed while walking at night and you're being told that they don't have
a claim. If that's the case, use the number below. Pick up your phone, give me a call.
I'm happy to answer these types of questions. I do so all the time. Don't wait, give me
a call. I'm Will Eadie. Thank you for watching and have a great day!
