A deposition is a process where parties to a lawsuit in court ask each other oral questions
under oath.
A court reporter is there to type up what is said. Sometimes, the deposition is videotaped.
The type of questions depends on the type of case. These questions ask basic things
such as where you live.

If its an accident case, were you hurt, were you treated, where, how long, and how much
did it cost, have you been hurt before, when and where, and have you treated before for
similar injuries to the same body part you claim is hurt in the current accident that
caused the lawsuit, etc.
Questions to the defendant in a car accident case may include was he drinking, has he been
convicted of a drunk driving or any other felony before, does he take medication that
would have impaired his driving, does he wear glasses, prior traffic tickets, accidents,
etc.
Both parties are trying to get information they can use at trial to their advantage.
They want information that makes the other side look bad or proves their version of the
facts is the right one.
In a car accident case, plaintiff wants to know if defendant has a history of causing
car accidents, while defendant wants to show plaintiff had prior injuries, or was not hurt,
or over treated, etc.
Attorneys for both parties can object to any questions at the deposition they feel are
improper, and if there is a real issue the court gets involved on the discovery issue.
Many times your attorney will object but tell you to answer anyways, and they will argue
later with the judge as to what the jury gets to hear, if any of it.
If the deposition turns nasty, your lawyer may file what is called a motion for a protective
order to stop the other side from asking certain questions or asking for certain documents.
