As a former police officer, I'm often
asked if I'm stopped by the police,
whether or not they look at my cell phone.
The answer is, unless you're under arrest,
they generally do not have the right
to search your cell phone, unless you give them
permission to search your phone.
So I tell people never give the police permission
to search your phone, and never give them your pass code.
If they searched anyway, without probable cause,
we can go into court, and get the evidence thrown out,
and likely get the case dismissed.
We may even be able to file a complaint against the officer,
and file a lawsuit against the police department
for a violation of your privacy.
