EEOC Extends Protection to Transgender Employees Hello, my name is Vincent White and I am an
attorney handling primarily employment law matters, discrimination, *** harassment,
things of that nature. Today I am speaking to you specifically as a discrimination against
Transgendered Employees. There’s exciting news in this field because as of April 20th,
2012 the federal agency the Equal Employment Opportunities Commission has extended protection
for Transgendered employees nationwide. This is important because although New York
State employees already had protection, Transgendered employees in New York State can now benefit
from added protection and added options under the federal laws. That means when you meet
with an attorney and you are discussing Transgendered discrimination with that attorney, make sure,
that attorney’s aware, both that he must protect your state law claims and your federal
claims. And have a serious discussion with your attorney about whether you should be
in state court or bring your claims in federal court.
In federal court you can bring your claims both under federal law and under state law.
There are quite a few advantages to a victim of discrimination to be in federal court.
For one thing, it’s significantly quicker than state court and generally there is a
greater understanding and greater cost to the discriminating party to pursue that case.
