There are a variety of laws regulating
littering in the state of Nevada.
Littering can often be difficult for a prosecution to prove.
You could be driving around in your vehicle,
a fast food back could fly out the window,
but it may that you had no intent to litter.
It is illegal in Nevada to purposefully throw a cigarette
out the window.
But again, it could be hard to prove that it was intentional.
The penalties for littering depend upon the substance
that is littered and where it's littered.
If it's a dead animal on your water stream,
it becomes a gross misdemeanor with up to a year in jail,
or a $2,000 fine.
Although, normally littering carries
a penalty of up to six months in jail,
and a $1,000 fine as a misdemeanor charge.
Dumping hazardous material, such as sewer sludge, or content
from a septic tank, can increase the penalties.
For a first time offense, it's a misdemeanor
with a penalty of up to six months in jail or $1,000 fine.
But for a second or third offense within a two year
period, the penalties go up making
it a gross misdemeanor with up to one year in jail.
And you can have mandatory minimum jail time sentences.
