Criminal Law and Medicine is important because it looks at and analyses the role of the criminal
law and its effect upon medical professionals, so doctors, nurses and other healthcare professionals
and how we go about regulating the kinds of things that they can do or not do to patients.
There are three important aspects to Criminal Law and Medicine. The first is that, obviously,
we have to look at the criminal law we also look at medical law, the third bit which that
is really important that we have to pay attention to is ethics because you cant really discuss
the criminal law, you cant really discuss how doctors act and what things they ought
to be allowed to do in particular in practice without considering the ethics of their situation.
So a fundamental part of the module is looking at the ethical aspects of doctors practises
and how the law regulates those sorts of ethical aspects. So we deal with issues like autonomy
and the value of life and what beings matter morally and those kinds of things so from
an ethical standpoint thats a fundamental part of the module.
The legal aspects that we cover are things that are more like what people assume medical
law I so questions about abortion or euthanasia, or whether or not doctors can kill patients,
and if so what happens, and the transmission of disease and confidentiality and those sorts
of issues. The module is taught entirely by 2hr seminars,
students are expected to read a selection of material that will include cases, it will
include articles, it will include books it will include any number of things. The students
are then asked to prepare that information and answer some questions that we then have
in a discussion format so the entire course (entire module) is taught entirely by seminar,
its all discussion led and students are expected to contribute and think about and
do all of the necessary work.
