What happens next? Hi. I’m Steve Brooks and I’m a criminal defense attorney in Massachusetts
with an office in Dedham and in Boston. And I can answer your questions about OUI drug
cases. While most people know what the symptoms of alcohol impairment are, such as in an operating
under the influence of alcohol case, operating under the influence of drugs is different.
In those cases, the government needs to call an expert witness in order to prove its case.
In order to give an opinion that the symptoms that the driver exhibited are consistent with
drug impairment, with the ingestion of drugs. Obviously, this creates some problems for
the commonwealth because the officers are not typically trained to recognize these types
of symptoms. A further issue is that the government also has the burden of proving that only certain
drugs were ingested to violate the statute. The statute is very specific on what it lists
for impairment. Every drug is not covered, necessarily. Now you’re watching this video
