Alki David sued
The latest news on the situation where Alki David sued CBS, CNET and Download.com is ongoing.
The thing to understand with this lawsuit is that he is suing because of the combination
on distributing file sharing software while at the same time promoting infringement. When
Alki David sued them he became a hero to both artists and people that use file downloads.
“–You cannot sell guns and tell people the best way to use them to kill people,”
says David in a news article source. He is not saying he is against file sharing on principle,
Alki is basically saying new file sharing methods will appear to fill the void once
this particular distributor is dealt with in the courts.
Alki David’s assault on the media giants appears partly based on the apparent hypocrisy
of companies like CBS trying to falsely brand Filmon as an illegal Live TV service. At the
same time, Alki David’s lawsuit and onslought of truth and justice claims that CNET was
allegedly, vicariously guilty of copyright infringement and material contribution to
copyright infringement. According to the court ruling, a judge has dismissed these two charges
but one charge she will allow to continue. Alki David is happy that the charge of inducement
is still being pursued. “Defendants here are alleged to have distributed specific P2P
software, while simultaneously providing explicit commentary on that software’s effectiveness
in infringing copyright. Such behavior moves beyond opinion into the realm of conduct and
does not directly implicate any First Amendment issues,” writes Judge Dale Fischer. The
defendants in the case seemed focused on the good news of the two dismissed claims instead
of on the one that remained.
