Hi, I'm Jan Grimes, Social Security Disability Attorney for Grimes Teich Anderson. Not surprisingly
people often ask a very basic question "What am I going to get if I win my case?" The answer
is three-fold. One, you will receive a monthly ongoing benefit. You will also probably receive
back payments and you become eligible for Medicare. Your monthly payment depends upon
your work history - how long did you work, how much did you pay in payroll tax towards
the Social Security System. The average payment in this year, 2012, is $1,013. It can be as
much as $2,513 once again depending upon your work history. Most people do in fact receive
back pay. Back pay is an attempt to partially compensate you for that period of time between
when you were disabled and when you were found to be disabled. Often quite a long period
of time back pay is limited by the fact that you were not paid for five months of that
period and also you cannot receive benefits beyond one year before you applied. These
back payments can amount to thousands of dollars and are much the result of the fact that the
process is so long, takes so long to conclude. You also will become eligible for Medicare.
Again there is a two-year waiting period. So from the time that you are entitled to
your first payment, two years thereafter you become eligible for Medicare. To some, this
medical benefit is as important as the monthly benefit. There's also that possibility of
other family benefits to dependent spouse or children. That can result in a benefit
up to 50% to 80% of the benefit due you as a disabled person. These computations can
be complicated and we would be happy to address those at any time if you wish to contact me
at this office or any of my staff. Thank you.
