Basically, an office action is a letter from the trademark office
informing you of deficiencies in your trademark application
that are preventing it from moving through the trademark registration process.
In general, you have 6 months in which to properly respond
to each issue raised in the office action.
If you don't respond to the office action by the deadline,
your trademark application will go abandoned.
Most of the time office actions raise
relatively minor procedural or technical issues
that can be overcome quite easily.
For instance, the office action may require that you slightly amend
the identification of products and services listed in your application.
Or the office action may request that you insert a disclaimer
of any merely descriptive wording that is part of your trademark.
These kinds of issues can often be handled
with a telephone call or informal email
to the trademark examining attorney
in charge of handling your application.
On the other hand, an office action may raise complex and serious issues
that need to be addressed before the trademark examining attorney
approves your trademark application.
For example, the office action might indicate that the trademark examining attorney
is refusing registration of your trademark
because it is likely to cause confusion
with another mark in an existing trademark registration.
Or the office action might indicated that your trademark application
is being rejected on the basis that your mark is merely deceptive
or geographically descriptive.
In these cases, it will likely be necessary
to research, prepare and submit
a detailed legal argument in order to attempt to persuade the trademark examining attorney
to withdraw the rejection.
