Today's article, I want to share with you something that appears in today's paper that
says “the school from hell.” And it describes a principal who can't control the students
in her school. And there's only about 88 students in this middle school, The Academy of Collaborative
Education. And they show photographs of a video that basically describes chaos. A mayhem
filled school shows kids congregating in the hall defiantly refusing to move, classrooms
that were vandalized after it was left unattended for a few minutes, and they go on in the article
to describe other horrendous things that go on because of a total lack of discipline.
So why am I bringing this up to you? I'm bringing this up to you because sometimes a student
will be injured during the course of a day in school. And many times the family will
have to turn around and show that the school district knew that there were problems with
the school, the administration, the school principal, and the teachers, and the aids
knew that there was something dangerous about what was going on. In order to show that school
knew about the problem or should have known about the problem and should have taken steps
to correct it before it reached dangerous proportions. According to this article, this
has been a long-going, ongoing problem in this particular school. So let's say, for
example, that a child gets injured and hurt during one of these episodes where the kids
are defiant and they're doing things that are disruptive. The question is can a child
or their parent bring a lawsuit against the city or the board of education for the school
being careless and negligent? It's quite clear that they know that they have an ongoing problem.
The question is what steps are they doing to remedy it? What are they doing to correct
these problems? What are they doing to correct the disciplinary problems? Because if they
don't take steps to do that, they may be held responsible if somebody gets injured as a
result of the problems that they see on a regular basis – especially ones that are
captured on video. If you find that your child has been injured, during the course of school
based on problems that the school knew about or should have know about, I encourage you
to pick up the phone and call me. You can reach me at 516-487-8207 or by email at lawmed10@yahoo.com.
