Let me tell you about a case in which a trial judge dismissed our case and we spent several
years righting a wrong and were able to prove that that judge, as well as an appellate court,
was also wrong. My name is Jonny Kool. I practice law in New York State. Not every case on the
motion level goes as expected. We had a case in which the trial court felt that there was
no issues of fact which warranted dismissal in favor of the defendants. Basically, the
case was dead for about 3 or 4 years. But consistent with the view of our firm and consistent
with who were are, we litigated that case. We had to prove that this trial judge was
wrong and we did. However, after that we then had to go to the appellate division which
is an interim court which also agreed with the trial judge and also felt that we were
wrong. We didn't stop there. We went to the court of appeals -- the highest court in New
York State -- and we were able to show that court that the trial judge as well as the
interim appellate division was wrong as well. We were able to then litigate that case for
another two or three years, a very long and hard fought litigation. And our client, who
was very very in difficult position because of the length of this litigation, was able
to recover a multi-million dollar settlement. And we were able to prove -- using our resources,
using our talents, using our abilities -- that even where a court goes against us we can
right the wrong and do the right thing for our client. It was a wonderful event when
we were able to pass the check to our client because that showed that we were vindicated
that we had told him what was right and we stood by our guns and we earned it for him.
