In New York State, we often hear the term wrongful termination and that can really be
misleading. In New York State unfortunately, we’re an at-will employment state and it’s
not illegal to fire someone for an unfair reason or maybe even no reason at all. Where
you are protected though, is if you have a collective bargaining agreement, you’re
in a union, or you have an employment contract. Or and this is the key in New York State if
you have been discriminated against or retaliated against because of some action you took, like
reporting discrimination or complaining that you’re not paid your overtime, blowing the
whistle on your employer. Things like that are protected, and that definitely something
you should be meeting with an employment attorney about.
