the republicans in oklahoma passed a ban on gay marriage in that state
judge kern a as
state a knows state supreme court order whatever was any
I don't know which kinda judges arm dollars US District Court
do US District Judge Terrence kern ruled that
this is a violation the Fourteenth Amendment's Equal Protection Clause of
the US Constitution
this is the basis on which most of these federal judges have been striking down
statewide bans on gay marriage
and so a republican
State Representative Mike Turner says okay if gays can't get married
are gays can get married it you know if the if we that's the way it's going to
be that much as do away with marriage
all together nobody can get married
seems a little odd to me in a kinda unusual position but
Boston Peterson thinks it's kinda cool and
I'm wondering why austin is a libertarian commentator is the editor of
the libertarian Republic dot com
dog libertarian Republic not come the website austin welcome back to the
program
thanks for having me Tom going to talk to you are you married
noope hopefully someday yeah
maybe one day okay so it's really not tom well
another reason I was asking was you know i mean you would when you get married
you
you I i've been married for 42 years YouTube understand that there are a
whole bunch of
laws that benefit you it's just like you know when you get rich when you know and
then in the years where I've made
a lotta money it I first the very first time I ever did
it shocks me that I didn't have to pay Social Security taxes anymore on
you know behalf by years in Cub as like wow this is really cool like that you
know the tax code
is skewed so that rich people help
make out even better than working people and I am
and I can tell you that the tax code is also skewed so that married people make
up better than single people
and we do that we do both those things because presumably there's some social
value the the republicans have convinced us that
having rich people around the country is a good thing and
I think pretty much everybody has convinced us that
we should provide some preferential treatment to marry people because we
want people to get married because that's a
an institution that has stability in is good for society so why would you wanna
be in marriage
well we're up on love and marriage I mean it just because the government
doesn't do it doesn't mean that people won't do it i mean
remember Tom the very first marriage laws in this country were meant to keep
blacks from Erin white
so it was about banning marriage to restrain interracial couples
and I would never want to ban marriage but I mean think about nine other very
hard very
laws and then about stopping polygamy so if marriage is good why not married with
two or three or four people maybe that's even better than
than not well the very few actually hurt the 1i want to be in the business of
telling people what is a social good or not
the reason why I X I was excited about this debate in oklahoma
was because they finally with was having the discussion
that marriage was a private contract and then and that under the
he cooled off a texan's that religious communities afford it was on the
fourteenth amendment
that mean that the government had which should have no say in telling people
that they can't have
i'm eric said one group of people can have a marriage and that other people
can
so exciting because even though I know if it's a little too optimistic for a
possible overall such as myself to believe that that's what actually
happened
it's taking a direction of up bringing it towards a libertarian conversation
saying that
the being marriages is a contract between people who love each other
and it doesn't matter what the government says and that the government
should not be banned for anyone I don't really honestly banning it
but I like the fact that people are talking about ESO uranium
have a plan to replace a filibuster any asked how the hell Austin please don't
filibuster me let's let's have a conversation I really have
four minutes left on also so
if I understand you correctly what you're saying is that
a society giving a tax preference basically to married people
is a violation the Fourteenth Amendment because single people don't get that tax
privilege
on would you say the same thing would you say the same thing
about people who own their houses rather than rent them should they get the
mortgage tax exempt exemption I think you can build a strong case for that
actually
I would say that yes sure I like and I really don't like government that picks
winners and losers yes right okay that are already a
I'm with you on that then would you say the same thing about
people who incorporate a business should they be able
to deduct from their taxes things like
me know three martini lunches and and
travel and staying in nice hotels in going to the Koch brothers
mansion and stuff like that well then everything is because I would've of the
tax code as well as it stands I would make out if I had a tendency to the fact
that a flat tax and that would be just across the board and I know you don't
like that but
so every iteration we pay the same tax I would not want to give any special that
anybody for any reason so every corporation would pay the same on
attacks
everybody would pay the same amount of taxes flat across the board so if you
start a
you start a small business and and you know your you're losing I mean typically
the you lose money the first couple years I've never start a business that I
didn't lose my first two years
on even though you've lost money you think that you that that business should
pay taxes
I lawyer thing as I started at six months ago and likely I've been
profitable for the last six months thank goodness
on what I you know I do take all the deductions I can just so I can stay
afloat but if I have the option to I would rather just a flat tax across the
board good as much less confusing I'm not very good at mathematics of
it takes a lot for me run my business and be able to do all the tax code so I
think it would actually be left to the burden
everybody knew what they had to pay at every year will be a
actually simplify thanked police are consistent it's so easy I but
debt is so so corporations should pay the same taxes as individuals
I think everybody should pay a flat tax across the border in love like we're
going to have a tax at all but I ideally I'd like to get ready attacked
the federal tax code that we have and a flat tax to me is just a stepping down
towards I'm really looking forward now coalition utmost limit access
by I'm while back on the marriage issue you know I think it's really exciting
nowadays I mean Tom you were talking about marijuana earlier like do you see
that that was a Republican who instituted that medical marijuana in
Georgia
yeah now here we see republicans pushing for what is a an advanced
I property like the constitutionality of marriage hearing all my mates
are you so excited to see me for the ride the classical liberalism most
republicans in america is in the early can you talk on here
using the word liberalism and the European context um
I think it's it's fascinating I
personally I think that we the people together
you know in in in in person assembled through our elected representatives
should pick some winners and losers we should
collectively say you know we understand morality
we understand that there are some things that are good for society there are some
things that are bad for society
that we're going to tax tobacco and alcohol and we're going to give a tax
advantage to people who get married
I you know I just think that you know you want to encourage some behaviors and
despair jeffrey Brown the people we disagree with and dominate a power
remember they will ban gay marriage because they will see this as a negative
well they have they have in the past 100 I think they have past 230 years
take away your rights when that the net when they oppose the power of party is
in power
the people you disagree with the understanding right away Tom I
understand that
understand that in fact you know gays have not had these rights for I didn't
buy it for 200 years and the first marriage laws by the way apropos you're
very
beginning filibuster was were were about
how women where the property if men women you know a.m. enid marriage laws
in America
started out as property laws and nurse and
they didn't really become tax laws until the early 20th century
and and then we started saying okay we've got these taxes let's use them
as as ways to encourage or discourage behavior that is good or bad for society
and I think that's a reasonable thing when we'd when one we
I do under those conditions when we actually have majority rule
I just don't think we have that right now I'm concerned about the the
billionaires ability to buy politicians
but that's kind of attention so army you would
you wouldn't you would say that people should get no no tax benefit if they get
married
no I me out and really feel that it's unfair now that leaving a single person
that I don't get that benefit from
again I don't know I don't want me imports more people to pay taxes I don't
want more people paying more revenue to government and I disagree with
so you don't become a man you just contradicted yourself
they ask you just contradicted yourself 400 or more people paying taxes on call
but I had if I had if you're forcing a gun to my head that I would say that I
would like like a fair system or everybody says the Tom Hartman program
yeah okay austin peterson on libertarian Republic dot com Thanks Austin
thank you tom will be back in 15 minutes past the hour
