I’ve just had some tenants move out at the end of their lease and they've left the place
in a mess and there’s damage to the bathroom door. What can I do to recover the costs?
You can make a claim against the tenants’ bond - to cover the cost of cleaning the property
and to repair the bathroom door.
Of course, you will need to substantiate the claim and you can do that using documents
such as the inspection sheets. They should describe the condition of the property at
the start and the end of the tenancy.
You will need to know how much you’re claiming. Invoices and receipts that show the amount
to clean the property and repair the door will help.
Once you know what the total costs are you can ask the tenant to sign the bond refund
form agreeing to the deductions and, if they refuse, you should lodge a security bond refund
form with us which claims against the bond.
What happens if the tenant don’t agree with what I’m claiming?
Still lodge the bond form with us and we'll notify the tenant of your claim and they’ll
be given the chance to dispute the claim.
If your claim against the bond isn’t disputed, the bond will be paid out, as claimed. If
your claim against the bond is disputed it’ll be referred to Tenancy Advice where a Tenancy
Officer will ask you to supply some more information about your claim and supporting documents.
The officer will then try to conciliate the matter and if that fails it can be referred
to the Residential Tenancies Tribunal for a determination.

Well, I spoke to a Tenancy Officer on the phone last week and he said I should give
my landlord a ‘request for repairs’ form asking him to fix the broken stove but he’s
refusing to get it fixed.
I want to go to the Tribunal.
OK. You need to submit a Form 7 application. And in this part of the form, you need to
explain what order you’re seeking from the Tribunal. So in your case you'd write “repairs
to the stove top”.
And then in the next part of the form you have to explain why you are seeking the order.
So perhaps give a bit of a history of what’s happened, and when you first told the landlord
and what happened then.
Once you've completed the Form 7 application and lodged it, a hearing will be listed and
you and the landlord will be notified by Hearing Notices in the post, and that will detail
when and where the hearing will be held.
