so here's the deal with prostitution stings. What the cops are gonna do,
is they're gonna go online they're gonna create an ad on backpage.com
are other sites like Craigslist where they'll go into the
escort section and post an ad with an explicit picture or
a seductive picture of a hot female basically saying
blonde bombshell looking for a good time I've got what you need
out give me a call and a John will call
and the whole phone conversation will be recorded
and they will be getting as much information as possible trying talk
about price
talk about sex acts talk about meeting at a hotel
and a lot of times these police officers will rent out a couple rooms at a local
hotel
and they will have the John come and meet the girl
the undercover officer will be wearing a wire
and she'll try confirmed that person she's meeting with is the same person
she talked on the phone
that this is about sex for money
and try and get out as much evidence as possible for the recording
once they approach the room typically as soon as they open that door
the other officers will arrest the individual. So I've had some clients in the past
say right when they're going to meet with the girl they had a bad
feeling and they were thinking
"I should just get out here." What if an individual would back out at the
last minute and not go to the hotel room? A lot of officers would still make the
arrest and they'll say just by going to the hotel room
just by approaching the room that's an act in furtherance
of prostitution and that's enough to get a conviction
One of the most common defenses for prostitution has to do with the intent involved
in order for the prosecution to prove that
an act of prostitution or an act of solicitation
was going on they have to show that there was intent to engage in ***
activity
a lot of times during these stings, there's ambiguous language being used
back and forth and that sometimes because of a language barrier between my
client and the police,
or some of the language being used by the cop, sometimes they just kind of
hint at things hoping that a client will start talking
sex, money, you know, right now. So
A lot of times there's legal defense there to play with.
Another legal defense that we can sometimes capitalize on is
sometimes some of my clients are just messing around;
they have no real intent to commit an act of prostitution,
they're just kind of seeing this girl who is very flirtatious and they're gonna
see
how far things can go with language but there's no real intent
to exchange money for sex, and sometimes I can capitalize on that
