Your case is coming up for trial and now just a few days before we're scheduled to begin
jury selection, you now have settlement discussions with the defense. If we don't settle your
case by the time jury selection starts, does the jury learn we've been having these settlement

great information. Hi. I'm Gerry Oginski. I'm a New York medical malpractice and personal
injury trial lawyer practicing law in the state of New York. Today I'm coming to you
from San Isabel Island, Florida and I have a few minutes to share this great information
with you. The answer is no they don't. The jury is never told about any settlement negotiations
and it doesn't matter if it's happening during the course of trial or before the trial actually
started. The jury is never to learn about that information. And why is that? It's because
they have nothing to do with any settlement negotiations that are occurring behind the
scenes with us and the defense attorneys. So the jury's function is to be the finders
of fact. They're to determine at trial who's more likely right than wrong. And now it's
our job to show to the jury exactly that in order to show them that our claim has more
validity than the defense and that we are more likely right than wrong. So the answer
is no, the jury never learns about any potential settlement negotiations or active negotiations
during the course of trial or even the negotiations that occurred prior to trial. You know you
might be thinking why do I need to know this information? Well you need to know this information
if you're contemplating bringing a lawsuit whether it's an accident case or a medical
malpractice case or even a wrongful death case in the state of New York. You probably
