Judge:The court has reached a verdict of guilty.
The court has reached a verdict of guilty.
he Court cannot agree with a lack of hate motive. The defendants position themselves
as supporters of feminism, that is, the movement for equal rights for men and women. But the
state guarantees equal rights! Belonging to feminism is not a crime, but is incompatible
with Orthodoxy, Catholicism, and Islam. Although feminism is not a religion, it intrudes into
areas that are significant to religion ... In the emotions and gestures of the defendants
we can see hatred ... The defense mentions that the Constitution is valid throughout
the Russian Federation, and because they are not attracted for the same actions by trolley
or in the subway, they can't be condemned for that. The "speech" - in quotes - of the
group "*** Riot" is not associated with a specific object ... but when moving to an
Orthodox church the object changes, as it has moved into the sphere of protection of
people in different areas. And in the disruption of normal routine CCS - there is only one
element of disrespect to the faithful ...
he Court finds that these actions offend, inciting hatred and enmity, which contradicts
the Constitution. Tolokonnikova, Samutsevich and Alekhina were obviously aware of the negative
reaction to their campaign, having deliberately prepared masks with slits for eyes and mouth,
and dresses. That is, this was a premeditated crime. The court considers the testimony of
the defendants that they did not have a motive of hatred with distrust, as a tactic of the
defense chosen to mitigate the punishment. There are no reasons not to trust the victims
and witnesses. From the victims' testimony, we have learned that all the actions of the
defendants and unidentified participants clearly expressed religious hatred and enmity. The
victims were deeply humiliated, they suffered non-pecuniary damage. Their actions were organized
for this.
The testimony of the witnesses and victims are consistent. It was observed that, in favor
of the prior agreement, the night before February 21st there was a rehearsal in the Elokhovskiy
Church, as well as in the back room. Tolokonnikova's discussion in preparing the action was also
documented. They had agreed to conduct videotaping of the provocative actions... they withdrew
the gown... (Masha's mother: "Why are they pouncing on the robe? It has sleeves!) Taking
into account the specific circumstances of the participants, time and location of the
crime committed, the court comes to the conclusion that the signs qualifying as hate in the name
of the accused as justified. The actions of the defendants are in violation of universally
recognized norms: using swear words in the immediate vicinity of the icons and relics,
the invasion of the solea and pulpit, disobeying the guards... the orientation of their actions
toward hate is confirmed by the spread of the video clip on the Internet, in order to
bring forth insult to other Orthodox citizens. Tolokonnikova, Samutsevich and Alyokhina put
themselves in opposition to people who share the Orthodox values, showing disrespect for
dogma that has been observed for centuries, instead putting themselves in the spotlight,
thus belittling citizens trying to communicate with God. Their vulgar actions have had a
negative psycho-social impact on a group of Orthodox believers - citizens who regard themselves
as connected to God. Tolokonnikova, Samutsevich and Alyokhina have claimed there were falsities
in the case file. But the court has not fixed an interest on our police colleagues in the
outcome of the case...
The expert who conducted the peer review was independent. The Court finds his conclusions
motivated and well-founded, and fully agree with them. The examination does not contain
contradictions, and no violations of the law of the Russian Federation by the court has been established. In addition,
the conclusions of the examination are consistent with the testimony of victims and witnesses
who confirmed the lack of political action during the protest in the church. Grounds
for declaring invalid expertise is not available. In addressing the petition by the defense
to call forth specialists, it was rejected because ...
The court finds the defendants' arguments that they did not intend to stir up religious
hatred and hostility untenable, because it contradicted the sum total of the evidence
in the case. Despite the fact that the band members of *** Riot say that their purpose
is political, that they are against the unification of the authorities and the church, these claims
are groundless. From the testimony of the victims there were no political slogans in
the church, and no names of any of the politicians were uttered. They are found guilty.
Tolokonnikova has a mixed personality disorder as evidenced by her active life position,
defending of social values, an elevated level of aspirations, and a tendency toward categorical
expression of her opinion. The psychological traits Tolokonnikova exhibits are not accompanied
by cognitive impairment, she was fully aware of her alleged actions, compulsory treatment
is not needed. Samutsevich has a mixed personality disorder - a perseverance and categoricalness
in asserting her opinions - and also does not require compulsory treatment. Alyokhina
has signs of emotional instability personality disorder - traits such as demonstrativeness,
inflated self-esteem, manipulativeness, disdain for common norms and rules, and a suicidal
tendency to blackmail predominate (this was
not in the text of the experts!). A tendency toward oppositional behaviors is observed...
The court takes into account the nature of the offense, the mitigating and aggravating
circumstances... Tolokonnikova - without previous charges, has a minor child, positively characterized
in place of work and study. Samutsevich - without previous charges, was not registered, was
characterized positively in her place of residence, we recognize as mitigating. Alyokhina - without
previous charges, is
not registered, has a minor child, was characterized positively in her place of work and study.
The court takes into account the views of the accused, and does not insist on serious
punishment of the accused. But the court regards the change of category of crime to a less serious
article as impossible.
VERDICT: "The Court believes that social justice can only be restored with an actual sentencing
with actual imprisonment and correction for the defendants. The court decrees: Tolokonnikova
is guilty under Article 213, part 2. 2 years total in the IK common facility. Samutsevich
is found guilty - 2 years. Alyokhina - 2 years. The punishment is considered retroactively
to March 15, 2012 for Samutsevich, while for Tolokonnikova and Alyokhina - from March 3.
