Under Nevada law, grand larceny is
defined as stealing and taking away
the property of another person that's valued at $650 or more.
If it's less than $650, then it would be petty larceny, only
a misdemeanor.
But grand larceny is a felony and potentially could
cost them to be sent to Nevada state prison
for a number of years.
Now, we see grand larceny filed oftentimes in situations
where somebody steals from their employer,
or steals property from a hotel room, or breaks into a house
to steal property.
In which case, they're likely to be charged
with burglary and grand larceny.
Grand larceny is a very serious crime in Nevada.
Depending on the value of the property that's stolen,
somebody could face up to 10 years in Nevada state prison.
And perhaps worst of all is that they
get a permanent criminal record.
And employers are very prone to not
hire applicants who have larceny or theft
convictions on their record.
That said, we find that many innocent people get wrongly
accused of grand larceny.
And this happens for a number of reasons.
I mean, first of all, a lot of times
it may be a situation where our client was found
to be in possession of some stolen property,
but really didn't know that it was stolen.
Had no idea that was stolen and certainly
wasn't the person who actually did
the stealing of the property.
Sometimes we have a situation where
our client was found in the company of somebody else
who stole property.
And the prosecutor tries to say that our client was an aider
and abettor, was somehow in on it.
When in reality, our client had nothing to do with it.
And was simply a bystander in the wrong place
at the wrong time.
Sometimes we find that the whole thing arose out
of a misunderstanding.
And maybe our client did take somebody else's property,
but our client honestly, and reasonably believed
that they had permission.
That they had a right to take the property.
And our client wasn't trying to commit a theft
or steal someone else's belongings at all.
