What happens if you're injured at work while you're in an
automobile? Hi. I'm Mike Kaspszyk of MHK Attorneys. We
handle these types of cases all the time. In one instance, our
client was working driving what's called a crash truck.
That's the truck you see at construction sites with the
flashing arrows telling you to get into the other lane. While
he was sitting in that truck, he was rear ended by a truck when
the driver fell asleep. Now he has two types of cases. One:
since he was at work, he has a worker's compensation case. But
he also has a lawsuit against the individual who rear ended
him. He came to us because his employer was trying to terminate
his worker's comp benefits. His employer said he was fully
recovered. We represented him in his worker's compensation case
and successfully defended against that termination
petition. Then the worker's compensation insurance company
agreed to settle his worker's compensation case for a lump sum
payment. We got him a substantial lump sum payment but
most importantly in this case, we made the insurance company -
as part of that agreement - agree not to be paid back out of
our case against the other driver. Because under
Pennsylvania law, when you have a worker's compensation case and
you're suing a different person who caused your injury, you have
to pay the worker's compensation insurance back all the money
they paid you. So in this case, I made the insurance company
agree not to do that and then we turned around and settled his
personal injury lawsuit against the other truck driver for a
substantial amount of money, and we did not have to pay the
worker's compensation insurance company back their lien. So if
