I mentioned it last week that the judge who had ruled
sure Scheinman
the US district judge who had ruled that
the New York Police Department had engaged in unconstitutional racial
profiling in its stop-and-frisk program
was essentially
deemed
last week to have violated ethics rules
apparently the same court
that'd deem that in thrown her of the case
issued an opinion on Wednesday
that they didn't really mean that she had violated the ethics rules
they said that they stood by the removal of shame when based on the impure
appearance
I've impartiality but they did not mean to imply that she was actually impartial
and they're cheering gauge the misconduct
either under the Code of Conduct or under the judicial
conduct so there was no ethics violation just an appearance a potential ethics
violation so
she will not be on that case however this will undercut
the Bloomberg administration's attempt to appeal her first ruling
because it's clear that she was in in fact
impartial she will not be on
the the case to determine how to execute
policies that will bring stop and frisk within a constitutional framework
but all this may be moot anyways as Bill de Blasio
will rejected the policy so I am
that's the end I love that little drama though it really does beg the question
what was going on with this appellate court
