What happens if you are partially at fault for causing or contributing to your medical
malpractice matter, your accident matter or (God forbid) your wrongful death matter? Would

Hi. I'm Gerry Oginski. I'm a New York medical malpractice and personal injury trial attorney
practicing law in the state of New York. Today I am coming to you from beautiful St. Martin.
I'm here on vacation with my family and I have a few minutes to share this great information
with you. So let's say that a jury determines at trial that you are partially at fault for
causing or contributing to the injuries for the harms and losses that you have suffered.
And let's say that they have also determined that you are entitled to be compensated for
-- let's say, hypothetically -- a million dollars. If the jury determines that you are
50% at fault and they also feel that you are entitled to one million dollars then the maximum
amount of money that you can achieve, that you can obtain, as a result of this verdict
will only be half of the amount that they are awarding to you. Why? Because you are
partially at fault. So the maximum you could ever expect to get would be $500,000 dollars
in this example. So why do I share this quick information? I share it with you because there
are instances where the injured victim may have caused or contributed to their particular
injuries and the defense will do everything possible to shift the blame from the people
that you have sued onto the injured victim. And if the jury determines that they are partially
correct and now that you are partially at fault for causing or contributing to your
injuries, then whatever amount they award to you at the end during a jury verdict will
then be reduced by the percentage by which you are found to be held partially responsible.
