When we are dealing with medical care in an Iowa work comp case often our clients will
ask us, "Do I have a right to a second opinion?" Well the answer to that is 'yes' you can always
go get a second opinion on your own using your own money or your own health insurance.
Sometimes it is difficult to find a doctor who will do a second opinion when workers'
compensation involved but you always have a right if you are able to find a doctor and
pay for it on your own dime. But there's also a requirement in workers' compensation that
the employer or insurance company provides you a second opinion once their doctors' have
said you are as good as you are going to get and they have admitted that your claim is work
related. At that point you can get what's called 85.39 examination where your employer or their insurance
company has to pay for your time you missed from work, your mileage, and also the expenses
for the examination, the report, and any additional testing that the second opinion doctor may
want. It is very important that you just don't go see any doctor for a second opinion in your workers'
compensation case though. There are doctors who are employer slanted, there are doctors who are
more neutral. And so it's very important that you select a qualified workers' compensation
doctor when deciding to have a second opinion. A qualified workers' compensation attorney
