If you have been arrested for DUI
there are usually two charges pending against you.
The first is the criminal charge.
You go to court to answer those criminal charges.
But you also, in most cases, a civil charge against you
dealing with the administrative suspension of your driver's license.
You only have 10 days after your arrest
to file for a request to contest that administrative suspension.
So for most people charged with DUI
it means they want to find an attorney within that 10 day period.
What we do for our clients charged with DUI is
we aggressively fight that administrative suspension.
There are a number of reasons why we do that.
First, if we win that administrative hearing,
then that means you are not going to have an
administrative suspension of your driver's license.
For most people charged with DUI
that is their immediate concern.
They need to be able to go to school,
to go to work, and
to take care of their family.
The second reason to have the formal review hearing is
because it is an opportunity for your attorney very early in the case
to subpoena all of the witnesses.
We have them come into the DMV hearing where they take an oath
and they have to give testimony.
Your attorney gets a chance to cross examine them which is very valuable.
That testimony can then be typed up into a transcript.
Then we can go to the prosecutor and say,
"Look, here is the transcript. Here is the problems with your case.
Here is why you need to reduce the charges to reckless or
you need to drop the charges completely."
It give your attorney a chance to show the prosecutor in black and white
all of the problems with their case.
Also, if your case goes to trial
your attorney now has all of the witnesses locked into what their testimony is going
to be.
So these administrative review hearings are very important.
The most important thing to remember is that
you only have 10 days after your arrest to preserve your right
to that administrative review hearing.
