You trip and fall on a broken sidewalk and now you've suffered significant injury and
you want to know if you bring a lawsuit what type of questions can you be expected to be
asked at your pre-trial question and answer session known as a deposition? Would you like

Hi. I'm Gerry Oginski. I'm a New York medical malpractice and accident attorney practicing
law here in the state of New York. Now you're contemplating bringing a lawsuit because you
suffered a significant injury when you fell over a defective sidewalk. The sidewalk was
sticking up and your foot tripped over this raised portion of the sidewalk. Well here's
what you can be expected to be asked at your pre-trial testimony known as a deposition
or an examination before trial. Mrs. Jones, tell me what type of footwear were you wearing?
Did it have a rubber sole? Did have a leather sole? Have you walked by this area before
or was this the very first time? When you were walking by tell us what you observed.
What was the weather like Mrs. Jones? Was it daytime, evening time, night time? Were
there any witnesses around? By the way, Mrs. Jones, do you wear eyeglasses? Do you have
any problem with your hearing? Did you have any earphones on? Maybe you were listening
to music. Were you on your phone talking to somebody at the time? Now what are these questions
designed to ask? The questions are designed out to find out from the injured victim what
they were doing as they were approaching the defective sidewalk. It's designed to find
out whether there's any medical problem. Whether there's an eye problem, a vision problem,
whether there's a dizziness problem that would be a problem with their ears, whether they
were being distracted and not paying attention as they're walking down the street. The attorney
who represents the homeowner (the property owner) is going to be asking you, the injured
victim, a lot of questions about what actually occurred in addition to finding out things
about your history as well as what you were carrying, what you were doing at the time.
Mrs. Jones were you carrying anything in your arms? Oh you were carrying your bag. Wonderful.
How heavy was the bag? Were you carrying any packages in your other hand? Was there anybody
with you? Were you in a rush to go somewhere? And all of these questions are to try and
find out if you may have caused or contributed to your own injuries. So why do I share this
great information with you? I share it with you just to give you an insight and an understanding
into what goes on in the litigation process in an accident case here in the state of New
