I yeah actually critter I recently fell on the ice at my job
and i'm a i'm a truck driver so I do it DOT drug test every two years anyways
which is no biggie
I the thing that was messed up so it when I follow
and we haven't been assault in because
in our economy the way it is they were trying to pension payments well I fell
on their driveway
and I go and I tell me no hair on my arms
they're like okay no problem I
they send me in for a drug test what and it wasn't just a drug test
it weighs a drug test because and the form that they gave me that they fill
out its says
pre accident post-accident or random drug test
they mark the random drug testing and when I asked our accountant what's up
with this
they're like yeah this will cover everything yeah
what they're trying to do is is a
prevent retain out now I think they're they're trying to prevent
having to pay out on workman's comp claim you were injured on the job
and you were arguably injured as a consequence their negligence
see you have the basis for a lawsuit and if they can demonstrate the you had
drugs in your system they can't they can use that as a as a as a defense
now by saying he was high that's why he felt it wasn't as we did in Salt the ice
and and he was high that's why he felt a stock as he was on the job and therefore
we don't have to pay workman's comp
or or we don't have to pay you know a a punitive damage for
for failing to provide a safe workplace and Rob time I just wanna let you know I
very much appreciate we think you on the radio and I just want to let their
be known that there is things like that happen out there as well and
azzam I was almost imagine that it would be extremely illegal to do something
like this
well it's you know welcome to America with the K i mean this
this is the cut your people say oh why would somebody suing employer
you know for I you fight you hear about the stories of abuse we actually had
this happen to us
we owned an advertising agency in in the in atlanta back in the 90's
and we hired a woman and
didn't do much of a background check on our call a couple employers but did not
a big deal
and two weeks on the job we at
we had a pretty press the basement you know these big cases a paper and she
goes over picks up this case a paper Louise
who was her supervisor my wife says don't pick that up we've got you know
we've got people who do that that's that you know the
year your you know it does look like you could even physically pick that up
and so she put on the box the next day she doesn't come and she's at the
doctors office

and so I'll in always called the workman's comp company and said
you know what's the story here and they said this is the third
jobber where she has gone to work injured herself within three weeks
and claimed at least a year's worth workmen comp benefits
are and we word recommended that you authorize us to pay her because
that the lawsuit will be more expensive so we ended up in a painless workman's
comp claim
arm that was unnecessary San so you hear these stories that kinda
in this is a story the villain is the employees but
here where you got an employer who
in of if I was working there I would be almost inclined to say I'm gonna call
lawyer
and take you guys down for trying to
to to you know FBI I think frankly Michael you have a basis for a lawsuit
and you know not that I'm recommending that you do that but it's like boy is
that an insult
you know it I been injured in Scopus enemy the clinic to get an xray on my
arm whether it's injured or not this %uh me to add to a drug testing facility
it's not and there there was like a big like punch in the face because like I
said I get a DOT tasks I get drug tested anyway
right know it's like this is this a high what yeah they're just trying to avoid
