-A common defense in a switchblade case is that
the prosecution cannot prove that you knew that
the switchblade was on your person.
For example, we've had clients who
have come to us after being stopped by the police while
driving and being searched, and the cops
find a switchblade in the car.
But that car had been used by other people
or the switchblade had been put there by other people.
And our client had no idea that the switchblade was even there.

21510 switchblade case, is that the police discovered the knife
as part of an illegal search and seizure.
So let's say that the police pulled you over in your car
and found the switchblade there.
Or maybe detained you on the street and searched you.
But you weren't committing any violations of the law.
You were not doing anything wrong.
And the police do not have probable cause
to stop and search you.
In those cases, we can run what's
called a suppression motion in court.
And if we're successful in doing that,
we can almost always get the evidence excluded.
And get the whole case dismissed.
