The biggest mistake that I see people make in the workers compensation system is to take
a settlement too early in the process. This unfortunately oftentimes happens through the
voluntary conference process. A voluntary conference is a setting where the injured
employee and the attorney for the insurance company of the employer sit down to discuss
the case. Oftentimes an offer of some cash payment is made to the employee. For particularly
small cases, this can be a fair way to resolve a work comp claim. However, if there is any
substantial disability these offers are oftentimes lower than what otherwise may be obtained
if the time was taken to properly document and work up the case. An attorney who is familiar
with the Missouri work comp law can help the employee to get the maximum benefit out of
the case.
