If you're in an accident should you
complete a written or oral statement? At the accident scene
if the police officer asks you to give your version
of the events you should be truthful and tell them what happened,
and you should try to protect your legal rights.
After the accident scene, after completing an oral statement to the police officer or a
written statement to the police officer,
we suggest that you do not make a statement to the insurance company,
either your company
or the other sides company until you talk to an attorney.
And what's the reason for that? Well your job is to try to protect your legal rights.
Oftentimes there's various legal issues like
contributory negligence, they might say that you were partially at fault,
or whether or not you were wearing your glasses, or
how your story sounds, that you need to talk to an attorney first
in order to protect your legal rights. So oftentimes
after a client is represented we will give a statement to
the insurance company, but its only with
the attorney on the phone and after we've practiced and prepared
for all the possible questions. Because you're really only going to get one bite
at the apple, you're going to give one statement and you want to make sure that
you don't kill your case by making an inappropriate statement.
