(Who will pay my car repair bills after an accident?)
Hi. This is Chuck. Every client in an automobile accident
one of the first problems that they experience is
how am I going to collect for the property damage to my car?
Under Ohio law if your car is
totaled and the definition of that is going to be that
the cost of repair is more than the fair market value of the car.
If your car is totaled the insurance company under Ohio law
has to pay you the fair market value of the car
plus tax and title and they have to pay
your rental car up until the time they make you
an offer on the totaling of the car. If the car is not totaled
then they have to pay for the repairs and an agreed price
between the insurance company and the body shop.
Also it's important to note that under Ohio law you are entitled to pick
the body shop or
the mechanic that repairs your car. You do not have to go
to the place recommended by the insurance company.
The important thing on your property damage is
that you should not accept full payment or sign the release on the property damage
until you've tested the car out after it's been repaired.
