the mechanic's lien process is used improperly
to obtain titles for a person who has difficulty
tracking down a prior owner to get a title a mechanic’s lien title is designed
for a legitimate repair shop to get a title to a vehicle that's been abandoned
at their shop let's say
you bring in a car for service you have some work done on it and you either don’t pay the
bill or
you never show up back to get that car now that garage
owner tow truck company repair shop has a vehicle they put money into
and it’s just sitting on their lot most states have a process where they can go
and
legitimately own that vehicle and sell it
for the purpose of paying off their debt
that's been accrued them and then any extra funds will go to the owner of the vehicle
that process is supposed to be advertised in a local newspaper for
three consecutive weeks sometimes longer
it’s supposed to be sold at a public auction and once it's all done a
title is issued to the garage for the sole purpose
of transferring it to somebody who legitimately bid the highest bid at a
public auction
it's not designed for that garage owner to help somebody get a title for the car
that's lost
in many cases when this process is abused
it'll come as a red flag to the department of motor vehicles attorney
general
and when they see a shop that’s processing a lot of these mechanics liens
they’ll come in and audit these mechanic liens to make sure they had assigned repair
order
somebody legitimately brought their car and there was auctioned off properly not
just
to wash the title through to get you a title for your vehicle in many cases the
titles have been pulled back later
people have even been prosecuted there was a case in Indianapolis where the secret service
arrested dozens of people who are processing the illegal mechanic’s lien so
if you see this offered to you as an option of getting a title for your
vehicle
be very wary of the documents you are signing that it’s
an affidavit that the car was actually brought to a shop that it was advertised
sold at public auction to the highest bidder in order to get the title of
those things that happen
