Here is a video of the bad and virtually non-existent service the government in Mexico provides to its citizens.
Mexico is by far not a democracy, but a nation ruled by tyrants waving a flag of democracy. In this first of many
videos you will see what I mean.
Me: Good morning, "Licenciada" (someone with a bachelor's degree).
(She made me wait 3 minutes as she was on the cell phone on a personal call)
Me: Good afternoon, Licenciada.
She: How you've been.
Me: Alright, and yourself?
She: Fine, thank God.
Me: Here is the petition in writing I had mentioned to you before for which I've received no answer. It was
received in this office by Licenciado Gasca, if you'd like to read it. Perhaps you have a reply somewhere and
have not made it available to me.
(She goes into mumbling some words in the document when she then appears to read it carefully. The document is
asking for an explanation on why a qualifying judge (juez calificador) dennied me the filing of a complaing
against someone for violations of the City Code, with no legal basis for doing so. The complaint was filed since
September 8, 2010, and this video requesting their response was recorded on August 12, 2011, almost a full year
without a response to a simple petition. Note the red herring she tries to throw as dialog follows:)
She: Well! If you present it to me, I will discard it, since within the code you're trying to file the complaint
they have a resource the citizen can use (didn't really understand her nor do I think she knows what she's talking
about; nevertheless, the content or her response is irrelevant. What I'm requesting is their response in writing).
She (continues): ...What I recommend is you go to them to file your complaint at the Public Safety Department,
because if I receive it, I will discard it as it legally can and proceeds (the discarding of my petition) for many
varied reasons (which ones I shall see in their document IF they answer it, which I seriously doubt they will).
First of all because you're not in time (legal timeframe), so it's not my intention, ok? (how considerate).
So, I would again advise you head over there (Public Safety Department).
Me: Yes, I've done that; therefore, I'm not here about the case per se, but about you giving me a response in
writing as I am entitled to by law, as you have to date expedited none whatsoever. So what I'm requesting is your
response in writing since you (Minicipal Judicial Department of Cuauhtemoc, Chihuahua, MEXICO) did sign me a copy
of received for which by law I am entitled to (the response in writing).
She: Oh, well, so I'll respond in writing, yet I am anticipating to you my response.
Me: Sure, no problem. I've already filed the corresponding lawsuits against the stated officials.
She: I will make copies of it, when was it received in this department? (She looks and finds out, wow! she's
a real pro!)
Me: The date is right there (she mumbles the date). Yep! It's been a while without a response.
She: I will answer this, but this does not have any legal weight as recourse of any sort.
Me: I know, but you are still obliged by law to answer my petition in writing. (She says this can be completely
discarded).
No problem, and if you do discard it be sure to jot down the legal foundation for which you are doing so.
(Gives me a look of did he really?)
She (after she hangs the phone): Yes, the reasons, well, first of all because the complaint is not due in this department.
Me: Of course! I also have other matters I'd like to discuss with you.
She: Excuse me? What matters.
Me: I have other matters I need your assistance with. I have this complaing against the Municipal Public Safety
Department for which I requested a police unit, and they did not send it. They told me I'd get a copy of the
corrective action file here at City Hall.
She: I'll be back.
Me: Go right ahead. (In the mean time you see a couple of youngsters doing nothing but flirting on a bench. That's the kind
of people the government is all but too happy to govern over). (You also see some guy coming out to see who I am.
She will bring him out with her for the rest of the conversation).
She: Let's see. I'll keep a copy, then. What else did you have at hand?
Me: Oh, yes, see they told me I would receive a copy of a file of a complaint I made yesterday against the City's
Police Department.
If you're not the indicated authority, let me know who it is, so I can go and request this file.
She: Let me look at the document to see what it's about. (After a few moments). What's this about? When did
it happen?
Me: Just yesterday.
She: At City Hall, they told you?
Me: Yes, they told me I could get a copy of the file.
She: No, I think they're misinforming you.
Me: Well, it's the same head of police command Victor Aguirre who sent me here. If you'd like to direct me to the
right person, I'll be more than glad to head over.
She: We have noting to do with this, or wait! Go downstars to the mayor's department at Human Resources.
(Lo and behold she was right on that one. Why was it so hard is my million dollar question).
Me: Very well! Let me see what else I have here. If you'd be so good to let me know where can I lookup the
City Code current to date for Cuauhtemoc, Chihuahua.
She: Certainly, see everything is published in the web page of transparency; if you don't have internet access that's okay,
because just downstairs there's a transparency module.
Me: Swell. They can provide me a copy (of the code).
She: IF YOU PAY IT! Because there's a cost per printout.
Me: Of course, (silly me I thought it was free for a minute there).
Alrghty, I'll head down there then for the web link and a printout, if that's the case.
Hmm, the court for the underaged. Is it still on Guatemala (street)?
She: Court for the underaged?
Me: Yes, as a general question. I have some business there with Licenciado Chaparro.
She: I've no idea what you're talking about. So, I don't know as that is not a department of City Hall.
Me: Maybe they'll tell me downstaris, right?
She: I doubt it, because that is not part of City Hall.
Me: Because Licenciado Chaparro took this case, I don't know if you're aquainted with him.
She: Nooo.
Me: He used to be there where Police Subcommander Chavez was stationed at.
She: That's another dependency you'll find it over on 7th street.
Me: So on Guatemala then?
She: Yes, somewhere over there.
Me: I also have this petition in writing against the Department of Motor Vehicles.
She: You need to go over there to request the response.
Me: Okay. I believe that's it. When can I come pickup my response?
She: You will be notified, did you put a return address on the petition?
Me: Of course.
She: That's where we'll notify you.
Me: So about how long will you be notifying me?
She: It depends. That will be done in due time.
Me: I mean it's been a while, so that's why I ask. Thing is there is no legal time limit for these responses
(and it's true. In Mexico there is no time frame for any authority to answer any petition, so they can take forever
to answer, which is usually the case).
She: Yes there is. (I'd like to see that. Matter of fact, I'll ask for this legal foundation see what she comes up with).
Me: Oh, really!
She: But we'd look into that (later).
Me: Of course, Licenciada. So long.
