Hi this is Charles Internicola and if you're a New Jersey
business owner faced with a partnership dispute you may have a question about what is an
order to show
cause. An order to show cause is
an emergency motion
that's filed by a partnership dispute attorney on behalf of his client
where you would seek challenge
injunctive relief. Injunctive relief is very important when it comes
to partnership disputes because these disputes have the potential
of unraveling an business impacting sales
and more importantly
diminishing and damaging the value of a partner.
So the term orders to show cause refers to the emergency motion
that an attorney would file with the court where you would seek injunctive
relief.
Forms of injunctive relief that are common for partnership disputes include
injunction prohibiting a partner from moving assets or diverting assets to another
business,
relief that would prohibit one partner
from locking out another out of the business operations
and where
a court orders that one partner not establish a competing business.
There's many variations to injunctive relief
and the effective ways that an
order to show cause can be utilized.
In my book The New York and New Jersey Partnership Dispute Guide we
go through an in depth evaluation of
New Jersey orders to show cause and in our evaluation
we give examples of various forms of injunctive relief.
If you'd like you can go to our website
and obtain a complimentary copy of the book.
I definitely recommend reviewing the section on orders to show cause
and evaluate and see what type of relief is sought in the
various orders to show cause that we give and evaluate how it could help you
with your potential dispute.
