Hi, I am Scott Maasen with the Maasen Law Firm. Today, I want to talk with you about
vehicular manslaughter cases. In Arizona, there are basically two types.
It's called manslaughter or it's called second-degree ***. Basically when you have this, you
have someone driving a vehicle, a motorcycle, a truck, a car. They have alcohol or drugs
in their system. They are acting recklessly and then they cause an accident, someone dies.
That would be manslaughter. In Arizona, the prison range for that as a first offense is
7-to-21 year prison sentence. It is very serious. It's a Class 2 felony, a very serious charge.
Above that, you have what's called second-degree ***. The second-degree *** charge carries
with it a 10-to-20 year prison sentence in Arizona as a first offense. In a second-degree
***, the state needs to show someone acted with extreme indifference to life. The example
that I use about that most frequently is someone has drugs or alcohol in their system. They
are speeding down the freeway over 100 miles an hour. They cause an accident, someone dies.
Very serious cases when you have a death and you have drugs or alcohol in your system on
board in dealing with that.
