so the other day we covered a story about the top Human Rights Court
in Europe banning life in prison without possibility of parole
because they say it's too harsh now keep in mind
these places already banned the death penalty so what we're looking at is
no death penalty and no life in prison without the possibility of parole
so I knew I'd get some criticism from my stance on it
but in all seriousness I didn't expect the level of disagreement that I got
so I'm going to double down but not just double down I also want to clarify
and hopefully I can change their minds
up some smart people so people misperceived
what I was saying as if it was a full-throated defense of the entire
criminal justice system in the US
but I'm not defending that so for example I'd legalize all drugs
i'd and three-strike laws on top of other things
and I gladly admit that yes in the United States we are too far on the end
on the criminal justice spectrum
where we do punishment and no rehabilitation
and usually when you to make criminal justice people are either for punishment
or rehabilitation but I believe in a third way
I think that they're both right and since there's different people and
different crimes
the answer is both things so sometimes you should do one hundred percent
rehabilitation
and zero percent punishment and sometimes you should do fifty fifty year
mix of the two which is probably a majority of cases
and sometimes you should do all punishment
and no rehabilitation because yes
there are people who are beyond even the prospect a rehabilitation
so my only point in that discussion
was that if you agree with the European Court
you're saying there is literally not a single crime that can possibly exist
that merits not having the possibility
of getting out of jail well I compiled a list I'll
actual criminals and their crimes but I think deserves
at least that amount of punishment andrei chikatilo
he killed fifty three women and children one of his crimes was on December 22nd
1978
he learned a 9-year-old girl to an old house which he bought in secret from his
family
and attempted to rate per when the girl struggled he stabbed her to death

find a way to convince a panel of people
that he's changed or that he converted to a religion or whatever he does good
deeds while he's in prison

but no I get it and my responses
if you care about human dignity how about the dignity
on the victim's for how about the dignity on the family of the victims
so they can rest easy knowing that they never have to worry about such monsters
getting out even if they're just a1 percent chance or 0.1 percent chance to
maybe
being granted parole because they duped over a barrel or whatever the case is
you really want them not to worry about that their entire lives
and Leslie there's a guy by the name of Danny Smith
furnace right and there's marlin Rex
you wanna know what these three guys have in common they were murderers who
got parole
and then murdered again now I'm not
saying you walk up everybody and throw away the key
or even every case that involves death
right i'm saying you use human judgment
and don't use a machete when you should be using
a scalpel like the European Court did when they were all that under
no circumstances is life without the possibility of parole
acceptable know there are many
circumstances where life without the possibility of parole
is the bare minimum what you should do and for the record
for all these particular crimes and many others which I omitted for time purposes
right
I actually think the proper punishment is the death penalty
now to be fair I understand that the death penalty has many problems because
many times we've convicted the wrong people so you can't have a system in
place
that kills innocent people because by that logic can you give that system
the death penalty right so I get that
if you're get the death penalty it makes all the sense in the world
all I'm saying is in a perfect world theoretically these guys deserve death
right
but I feel very least you should be able to acknowledge they didn't they
deserve life in prison without the possibility of parole
because these guys are beyond any prospect rehabilitation
