Hi, I'm Kim Redding on behalf of Mine Safety Center.
Today were here to talk about the new changes with the Pattern of Violation
laws that MSHA just recently changed. In the past if you were approaching
Pattern of Violations, meaning you had too many S&S Citations during a
one-year period, they would issue a notice before you would reach that point.
Now, you will just be issued a Pattern Violation ticket and it's up to you to
monitor these patterns ensure you don't reach that point. Where you find
these numbers is going to MSHA's website, pulling up your Mine ID number on the MDRS
part of the website.
You'll pull up PPOV and they show where you fall in the Pattern of Violation
criteria.
So in the past when you would contest your citations they wouldn't be
considered a citation
because there were still going to the court system to be adjudicated. Regardless
of whether you're fighting your citations are not, those citations will
now count against the numbers that they use to determine whether you have
exceeded and met the criteria for Pattern of Violation. MSHA has
changed part of their criteria is that they look at mitigating circumstances
that the mine operator has established to try to curb or change their pattern.
Things they'd be looking at is training, self-audits,
things that the mine operator can show that they're doing to turned the ship or
turn away from MSHA then triggering 108 of the Mine Act where
they can put an injunction property.
