Jason: Good morning, and welcome to another edition of Getting Legal with Tim Misny. We're here
at the Diner on Fifty-fifth street. Tim: Our favorite spot. Jason: Yes, and Tim
last couple episodes, we've been discussing medical malpractice.
One area we haven't gotten into is
how long does someone have
if they think they're been a victim of medical malpractice
to bring a claim?
Tim: Very important question, Jason. Typically,
there's a one-year statute of limitation.
What a statute of limitation means is, that
by law, by statute it cuts off the time that we have to bring a claim. Jason: So one year?
Tim: That's right. In most negligent cases, car accidents ect it is a two-year
statute. In medical malpractice it is a one-year. But let me qualify that, please? It is
one year from the date that you
reasonably should know that there is medical malpractice, or one year from the date that the
physician,
patient relationship ends.
Or one year from the actual date of the medical malpractice. So it is a one year statute, but
it gets very, very murky. Jason: This sounds very confusing because
as you were explaining
it's not just one day from, it could not be just one day from the year
that you are going in to see a medical person or or are getting something
diagnose for that kind of thing. Tim: That's why it's critical to call me. Oftentimes,
people want to get the estate in order if someone dies as as result of medical
malpractice and they wait over a year and they call me after a year. And say, well Tim we
finally got everything together. Our family wants to pursue a claim. So you say that you
past the one year statute, and they say, well I thought there was a two-year statute?
So the bottom line, something happens call me right away. Jason: Okay, so if I think I've
been a victim, what is that the one thing that I need keep in mind?
