Hi. My name is Phil Rarick. I am a Miami probate attorney with Rarick & Beskin.
Probate is the legal process for transferring assets owned by the decedent according to
the decedent's will or Florida intestate law to his or her beneficiaries after all legitimate
creditors of the estate have been paid.
Be warned: Florida probate is a bureaucratic, time consuming and expensive process. You
can best navigate this process by using an experienced probate attorney that concentrates
in this field of law. An attorney not experienced in Florida probate is likely to cost more
and take more time.
The two most common types of probate administration are Summary Administration and Formal Administration.
Summary Administration is the Fast Track process. However it can only be used for estates valued
at $75,000 or less, or if the decedent has been deceased for over two years.
Formal Administration is typically required for all estates where summary administration
is not available. A formal administration can easily take 9 months or more.
