-In Penal Code 288, California law
defines the crime of lewd acts with a child
as touching a child somewhere on his or her body for the purpose
of sexually gratifying either the perpetrator or the child.
Now, most commonly, we see these cases
where there's some allegation of an overt touching or fondling
or stroking of the *** organ, so rubbing the vaginal area,
or attempting to *** the child,
or putting the child's hand on your ***.
However, the contact does not necessarily
need to be on a *** organ.
It could be on a leg or a cheek or the face.
And it doesn't even have to be on the child's bare skin.
It could be over the child's clothes.
The key is that to be the crime of lewd acts with a child,
it simply has to be touching the child anywhere on the child's
body for the purpose of *** gratification.
