I have a number of clients and I just had a client the other week that came in. There
is a federal rule out there of gifting that says that you can gift $13,000 per person
or a couple, husband and wife, can give to their children $26,000 – that is the IRS
federal rules, the Medicaid Title 19 rules ignore that completely – and that goes from
dollar one. So there is a perception out there that you can gift up to this federal limit
without being disqualified or being penalized, and that is incorrect, that’s an IRS rule,
not a Medicaid Title 19 rule.
