Are you wondering if your ex can withhold visitation because you're behind in your child
support? Let me help you with that question. My name is David Pisarra, I'm with MensFamilyLaw.com.
the short answer is No. Because Child Custody and Child Support are in theory separate issues
that are not supposed to infringe on each other.
Your ex cannot withhold your court ordered visitation if you are behind in your child
support. Doesn't matter if you're behind a day, a week, five years. the point is that
you have a court order that says you are supposed to see your child on whatever the days are.
that is a court order that she must abide by. That's a separate issue from whether or
not you're supposed to be paying child support. IF you're supposed to be paying child support,
whether or not you've had a loss of your job, a drop in your income is not relevant to whether
or not you're supposed to pay child support. If there's a court order for you to pay X
amount of dollars per month you must pay that. If you need to go in and have that changed
because of you've suffered a drop in your income or the loss of a job, you have to go
in and start doing that process, but that's a separate issue from whether or not your
ex can withhold your opportunity to have a relationship with your child. Why do I tell
you all this? Because I answer questions like this on a regular basis. Please feel free
to check out our website, read my blog, read my books, watch the other videos and if you
still have questions, feel free to give me a call, I'm more than happy to talk to you.
Take care and remember a cheeseburger and a chocolate shake will get you through just
about everything.
