Welcome and thank you for joining me today. I'm Steve
Brooks, a wrongful death personal injury and social
security disability attorney practicing here in the state of
Florida. Today's video tip answers the question of, "How
long will my social security disability claim take?" I get
asked this question all the time. I'll start out with each
case is unique depending on where you are in the process.
But, the initial application is going to take about 3-6 months
and about 70% of those cases are denied. If you're denied the
initial application, you have to file a re-consideration which
takes another 3-6 months and close to 90% of those cases are
denied. You have 60 days to appeal each of those denials. If
you are denied the re-consideration then you would
have filed a hearing before an administrative law judge. Now,
you can easily add 4 months to each of these denials by waiting
until the appeal deadline. It's important for you to immediately
file your appeal. Then you can provide any missing paperwork
later, but immediately file. Now, it's been my experience
that the earlier you retain an attorney the better chance you
have of moving the claim along administratively, faster, and
ultimately prevailing your appeal. Because the earlier an
attorney gets involved, he'll make sure all the deadlines are
met. Most important reason you want to retain an attorney early
in the process is not only to make sure that all the deadlines
are met so that you don't have to start the whole process over
- which is something I see all the time by the way, but the
attorney can clue you in on all the little nuisances you're
going to need to do to make this claim work. I urge you to pick
