Here's a TV ad by a doctor and a hospital that I would love to see. Come join me. I'm
Gerry Oginski. I'm a New York medical malpractice and personal injury trial lawyer and I'm having
a little fun today trying to come up with an advertising strategy for a doctor or hospital
that caused you harm. So let's play along and see what kind of ad might trigger a chuckle,
even though you suffered a significant injury. "We're sorry. We're sorry for not telling
you all the risks of surgery. We're sorry for not disclosing that this was the second
time the doctor did this procedure. We're sorry for not having the senior doctor supervising
the resident who caused you harm. And we're sorry for giving you the wrong medication.
We're sorry. Now you have a nice day and please don't sue us." And what's the likelihood of
this type of ad ever appearing on TV? The answer is absolutely zero. So why do I share
this with you? I share it with you because I was just having a little fun with common
defenses that we see all the time in medical malpractice cases where the doctor turns around,
never admits that he's sorry. Where the doctor tries to protect his behind, as well as the
hospital's behind. They never want to point fingers at each other because then it makes
it easy for us during the course of trial to go forward. And once the two defendants
-- the doctor and the hospital -- are now pointing fingers at each other saying, "Hey.
Don't blame me, it's the hospital's fault." And the hospital turning and saying, "Hey.
Don't blame me. It's the doctor's fault." Now it becomes easy. We can pretty much sit
back and let the jury figure it out for themselves, which one or both are responsible for your
injuries. But this is something that happens all the time in terms of common defenses that
we see in these medical malpractice cases. And I was just being a little creative, having
a little bit of fun and I thought it would make a nice creative video about an ad that
we would never, ever see. You know, I realize you're watching this because you likely have
