-Under penal code section 21310, possession or carrying
a dirk or dagger in public is a wobbler.
That means that the prosecutor could file it
as either a misdemeanor or a felony.
If it's filed as a misdemeanor, the penalties
are up to one year in county jail.
However, if it's filed as a felony,
the penalties are up to three years in state prison.
Moreover, under either case, it would give you
a permanent criminal record.
And the fact is that prospective employers, when
you go to apply for a job, get very nervous when
they see possession of a weapon convictions on your record,
because they wonder, why does this person have a weapon?
Are they dangerous?
Or would they be a risk in the workplace?
So it's very easy to pass over applicants
in that situation for a job.
Therefore, to the extent that you're charged now
with possession of a dirk or dagger,
you want to do everything that you can to fight the case
and keep it off your record.
